Automated Patent Research: The Shift to Agentic IP Decision Intelligence

Most IP teams no longer need convincing that AI can help with patent research. AI-assisted search has already become part of professional patent workflows in both companies and patent offices. For example, even at USPTO, more than half of patent examiners regularly use AI-powered similarity searches as part of their examination workflows.

As these capabilities become common, the quality and transparency of the underlying research matter even more. In this article, Manish Sinha of PatSeer examines why reliable patent intelligence depends not only on AI-assisted analysis, but also on the quality of the search, evidence and context behind it. A polished FTO claim analysis has limited value if a relevant prior-art reference was missed. A patent quality or value score is equally difficult to rely on when the evidence behind it is unclear.

When you use AI to support a patent decision, you need confidence in the research behind the answer. Did the search find the right documents? Were the relevant claims and family members considered? Was the legal status checked in the right jurisdictions? Was claim construction done properly? Can you trace the conclusion back to the supporting evidence?

Reliable patent intelligence starts there.

Better Decisions Begin with Better Evidence

AI can help with search and review. But review AI can only analyze the material that enters the search process. If an important document is missing during retrieval, every later stage of analysis starts with that gap.

Good patent research therefore depends on both relevance and context. A narrow result set risks missing important prior art, while an overly broad one can bury the documents that matter most. For novelty or invalidity work, reliable analysis depends on finding the closest technical disclosures and mapping them correctly to the claims. In FTO, family relationships, jurisdiction, and current legal status can completely change which documents deserve attention.

The principle is simple:

Better search → stronger evidence → more reliable analysis → better-informed IP decisions

This principle sits at the heart of IP8.

Why the PatSeer Foundation Matters

PatSeer combines comprehensive patent data (including updated patent families, legal status, and citations) with powerful AI and Boolean search engines, alongside AI-powered NPL search. IP8 builds on this research foundation, using PatSeer’s integrated AI and Boolean search infrastructure to carry validated evidence into deeper analysis.

That is crucial because patent researchers rarely rely on a single search method from start to finish. They may begin with a structured Boolean query to build a precise starting set, then use AI to refine the results and then AI-based similarity searches around a relevant patent found. Alternatively, they begin with a series of AI searches, combine the results and then use Boolean to narrow down within it.

PatSeer saw early adoption of AI Search soon after its July 2023 launch. Within roughly a year, users were already turning to AI Search for more than one in every ten searches on the platform. Its AI search engine is now in its third generation, and AI Search now accounts for roughly one in every four searches. PatSeer has also extended AI beyond search into review and analysis through capabilities such as Semantic Mapping and Ask & Refine.

IP8 builds on PatSeer’s evolution from AI-assisted search to review and analysis by connecting retrieval, analysis, and the decision that follows.

From Patent Information to Better Decisions

IP8 is a Patent Decision Intelligence platform built to support decisions across novelty, FTO, validity, portfolio strategy, and monetization. It organizes retrieval and analysis into five connected intelligence workflows; each built around a specific IP decision.

Novelty Intelligence goes beyond finding similar prior art by classifying references according to their patentability significance: X-type novelty threats, Y-type obviousness candidates, supporting background, and peripheral art. It also identifies reference pairs with complementary teachings and highlights invention features that remain undisclosed by the strongest prior art.

Invalidity Intelligence organizes the search around individual claim limitations rather than overall patent similarity. It shows what each reference covers, what it misses, and which single-reference or combined prior-art paths deserve closer attention, while uncovered limitations indicate where further searching should be concentrated.

FTO Intelligence distinguishes technical similarity from actual clearance relevance. By mapping claims against product features and classifying results as Blocking, Potentially Blocking, Relevant–Non-Blocking, or Background, it helps move the patents most likely to affect a launch decision to the front of the review queue.

Portfolio Intelligence moves beyond a binary keep-or-prune review by showing the different roles patents can play across the portfolio. It cross-references your patents against your and your competitors’ products to determine their current strategic relevance and assertability. This way your patent portfolio can be segregated for investment, protection, licensing, enforcement, or abandonment, with the reasoning behind each position available for review.

Monetization Intelligence can begin with the patent rather than a known target. It searches the wider market for potentially relevant products, maps claim elements against supporting technical evidence, builds citation-backed Evidence of Use, and can continue monitoring products as new evidence emerges.

Every workflow is powered by the same retrieval-first intelligence foundation, combining agentic research, element- and claim-level analysis, and evidence-backed reasoning. A human-in-loop design allows users to intervene, if required, at each stage where value addition can help. The objective is to move beyond document similarity and long result lists to give IP teams decisions they can inspect and defend.
